Court of Protection Guideline Hourly Rates

It is with much delight that we are able to reach out to you all today with some good news.

This morning, Wednesday 30 September 2020, judgment was handed down from Master Whalen at the SCCO, ruling that it was not appropriate to apply the guideline hourly rates, set as long ago as 2010, to Court of Protection work undertaken by deputies.

With that in mind, rates were allowed at some 20% above the 2010 guideline rates. The Master went on to advise that such rates can apply for work undertaken as far back as 2018 and can be applied immediately going forward. This means that for any assessment that has not yet been filed, these new rates can be applied.

I am sure you will agree this is excellent news for the profession and long awaited.
